Where is the Evidence?

As part of the States’ case they depended heavily on fingerprint cards they claim came from the crime scene. Since Harrods’ defense team were not allowed to test the cards and police did not collect and secure the evidence from the crime scene, this remains at question.

Evidence Destroyed by FBI

The main piece of evidence, a glass window pane was left at the crime scene eliminating any chance for future examination OR to pull genetic material (DNA) from. Other items were lost after the trial. In fact, according to the prosecution ALL DNA evidence from this case was destroyed by the FBI  Laboratories. All this DNA evidence and the materials from the crime scene are gone!

Finger Print Identification in Question

During a resentence the former head of the Phoenix Police lab changed her testimony on how they determine the match for prints. She admitted they used a “zero” point check, most states use at least a seven point match while some use even more. According to Harrod without the “actual evidence” from the crime scene there is no way to test for DNA or to prove his denial of the State’s print theory.

Rights Denied

According to Arizona’s Rules of Evidence Harrod was in fact denied his rights.
